These Terms & Conditions apply when you visit our studios, book a class, purchase a membership or package, use our website or interact with Poise Studios online.
By booking a class, purchasing a membership or package, creating an account, or using our website or services, you acknowledge that you have read and agree to these terms.
1. ABOUT POISE STUDIOS
Poise Studios is a boutique movement and wellness studio offering Pilates, yoga, reformer classes, heated classes and related wellness experiences. Our studios currently include: Poise Studios — Mat Studio 2120 St. George Avenue Saskatoon, Saskatchewan Poise Reformd — Reformer Studio Unit 10, 1932 St. George Avenue Saskatoon, Saskatchewan Poise Studios reserves the right to update, modify, relocate, suspend or discontinue classes, services, instructors, schedules, memberships or studio offerings from time to time.
2. CLASS BOOKINGS
All classes must be booked in advance through the Poise Studios website at PoiseStudios.ca or through the Poise Studios app. Your booking is not considered confirmed until it appears in your account. Class spaces are limited and are available on a first-come, first-served basis. 1You are responsible for ensuring that the information associated with your account is accurate and up to date. Poise Studios reserves the right to refuse or cancel a booking where necessary, including where a booking has been made in error, an account is not in good standing, or a client has violated these Terms.
3. CANCELLATION & NO-SHOW POLICY
We have a 10-hour cancellation policy. If you cancel a class more than 10 hours before the scheduled start time, you may cancel without incurring a late-cancellation fee. If you cancel within 10 hours of class, a $15 late-cancellation fee will apply. If you do not attend a class and do not cancel your booking, the class will be treated as a no-show and the applicable no-show fee will apply. For memberships, no-shows and late cancellations are subject to the applicable fees associated with the membership. We understand that emergencies happen. Any exceptions to our cancellation policy are at the discretion of Poise Studios and may be considered on a case-by-case basis. Repeated late cancellations or no-shows may result in additional booking restrictions.
4. MEMBERSHIPS
Memberships are subject to the terms presented at the time of purchase. Memberships may include recurring payments and automatically renew according to the membership terms unless cancelled in accordance with those terms. Membership fees are non-refundable except where required by applicable law or expressly stated otherwise. Memberships are generally non-transferable and may not be shared between individuals. You are responsible for ensuring that your payment information remains current and valid. If a payment is declined or otherwise remains unpaid, Poise Studios reserves the right to suspend membership privileges until the account is brought into good standing. 2Nothing in these Terms limits any cancellation rights provided to consumers under applicable Saskatchewan law.
5. MEMBERSHIP CANCELLATIONS
Requests to cancel a membership must be submitted at least 30 days before the next scheduled billing date, unless otherwise required by applicable law or the specific membership agreement. Cancellation requests may be submitted by email or through an official Poise Studios social media direct message. Submitting a cancellation request does not automatically cancel a payment that has already been processed. Where required by law, statutory cancellation rights will continue to apply regardless of the cancellation procedure described above.
6. MEMBERSHIP FREEZES
Eligible memberships may be frozen for a minimum of 7 days and a maximum of 90 days per freeze. Membership freezes are limited to four freezes per calendar year, unless otherwise approved by Poise Studios. Freeze requests must be submitted before the requested freeze begins. The terms, fees and eligibility requirements applicable to a freeze will be communicated at the time the freeze is requested.
7. CLASS LEVELS & AGE REQUIREMENTS
Unless otherwise stated, Poise classes are designed to accommodate a range of experience levels. Our instructors may provide modifications or alternatives based on individual ability. Reformer: Participants must be 16 years of age or older. Mat: Participants must be 14 years of age or older. Participants under 16 require parent or guardian consent. 3Certain classes, events or programs may have different age requirements, which will be communicated at the time of booking. Poise Studios reserves the right to determine whether a particular class or program is appropriate for a participant based on the requirements of that class.
8. ARRIVAL & LATE ENTRY
Please arrive early enough to prepare for your class. For safety and respect for the experience of other clients, studio doors may be locked once class begins. For early-morning classes where no front desk staff are present, doors may lock precisely at the scheduled class start time. Late entry may not be permitted once a class has begun. If you arrive after the doors have been locked, your absence will generally be treated as a no-show and the applicable no-show fee will apply.
9. REFORMER STUDIO REQUIREMENTS
Grip socks are required for all reformer classes. Clients must follow instructor directions and use reformer equipment only as instructed. Poise Studios reserves the right to restrict participation where a client is using equipment in an unsafe manner or otherwise creating a risk to themselves, another participant or the studio.
10. HEALTH & PARTICIPATION
Participation in Pilates, yoga, fitness and other physical activities involves inherent risks. You are responsible for determining whether you are physically able to participate in a class or activity. Please inform your instructor before class of any relevant injuries, limitations, physical conditions or other circumstances that may affect your ability to participate safely. Poise Studios and its instructors may provide general movement instruction, but classes are not a substitute for medical advice, diagnosis or treatment. 4If you are unsure whether participation is appropriate for you, consult a qualified healthcare professional before participating. By participating in a class, you voluntarily assume the ordinary risks associated with physical activity.
11. PERSONAL BELONGINGS
Clients are responsible for their personal belongings while visiting Poise Studios. Poise Studios is not responsible for lost, stolen or damaged personal property, except where liability cannot legally be excluded. Please avoid bringing valuables into the studio whenever possible.
12. STUDIO CONDUCT
We are committed to creating a welcoming, respectful and inclusive environment. Clients are expected to treat instructors, staff and other clients with respect. Poise Studios does not tolerate harassment, discrimination, threatening behaviour, intimidation, violence, abusive conduct or intentional damage to studio property. We reserve the right to refuse service, remove a participant from a class or suspend or terminate an account where we reasonably believe a client's conduct is inappropriate, unsafe or inconsistent with our studio standards.
13. STUDIO CLEANLINESS & EQUIPMENT
Clients are expected to treat studio spaces and equipment with care. Please follow posted studio procedures regarding cleaning equipment, returning props and maintaining the cleanliness of the studio. Poise Studios may require a client to discontinue use of equipment where it is being used improperly or may present a safety concern.
14. CHANGES TO CLASSES & INSTRUCTORS
Class schedules, instructors, formats and locations may occasionally change. Poise Studios may modify or cancel a class where necessary due to instructor availability, operational requirements, weather, emergencies, maintenance or other circumstances. Where a class is cancelled by Poise Studios, the applicable booking will be handled in accordance with the applicable booking or membership terms.
15. PAYMENTS
All prices are listed in Canadian dollars unless otherwise stated. Applicable taxes will be added where required. By making a purchase, you authorize Poise Studios and/or its payment processor to process the applicable payment. All purchases are subject to the terms presented at the time of purchase and any applicable consumer protection legislation. Poise Studios reserves the right to correct pricing or other errors and, where appropriate, cancel an affected transaction.
16. PROMOTIONS & SPECIAL OFFERS
Promotions, introductory offers, memberships, packages and special events may be subject to additional terms. Unless expressly stated otherwise:
Promotional offers cannot be combined with other offers. Promotional pricing cannot be applied retroactively. Offers are subject to availability. Promotional memberships or packages may have specific expiry dates. Poise Studios reserves the right to modify or discontinue a promotion where permitted by law. Any additional terms presented with a promotion form part of these Terms.
17. PHOTOS, VIDEO & SOCIAL MEDIA
Poise Studios may photograph or record classes, events or activities for promotional, marketing and social media purposes. Where required, Poise Studios will seek appropriate consent before using an identifiable individual's image for promotional purposes. If you do not wish to be photographed or recorded, please notify a member of the Poise Studios team. Clients may not photograph or record other participants without their consent. Please respect the privacy of other members when creating or sharing content inside the studio.
18. WEBSITE & INTELLECTUAL PROPERTY
All content appearing on the Poise Studios website, including our name, logos, branding, photographs, graphics, written content, videos and other materials, is owned by or licensed to Poise Studios unless otherwise stated. You may not reproduce, modify, distribute, sell or commercially use Poise Studios content without prior written permission. The Poise Studios name, branding and related intellectual property may not be used in a way that suggests an unauthorized affiliation, endorsement or partnership.
19. WEBSITE USE
You agree to use the Poise Studios website and booking systems only for lawful purposes. You must not:
Attempt to gain unauthorized access to our systems; Interfere with the operation or security of the website; Use automated systems to make bookings; Create fraudulent or misleading accounts; Submit false or misleading information; or Use the website in a way that could damage Poise Studios or its clients. We may suspend access to our website or booking systems where necessary to protect our business, systems or clients.
20. THIRD-PARTY SERVICES
Poise Studios uses third-party service providers to operate portions of our business, including payment processing, communications, website hosting, analytics and other business functions. When you use a third-party service, that service may collect or process information in accordance with its own privacy policy and terms. Poise Studios takes reasonable steps to work with service providers that provide appropriate safeguards for personal information under their control.
21. CHANGES TO THESE TERMS
Poise Studios may update these Terms & Privacy from time to time to reflect changes to our services, operations, technology or legal requirements. The updated version will be posted on our website with a revised "Last Updated" date. Your continued use of our services after an update constitutes acceptance of the updated terms to the extent permitted by law.
22. GOVERNING LAW
These Terms are governed by the laws of the Province of Saskatchewan and the applicable laws of Canada. 11Any dispute relating to these Terms will be subject to the applicable laws and courts of Saskatchewan, except where applicable law provides otherwise.
23. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary, and the remaining provisions will continue in effect.
24. ENTIRE AGREEMENT
These Terms, together with any additional terms presented at the time of purchase or booking, constitute the agreement between you and Poise Studios regarding your use of our services, except where a separate written agreement applies. Where a specific membership, promotion, event or service has additional terms, those terms will apply to the extent of any conflict.
25.SMS TERMS & CONDITIONS
1. Program Description
By opting in, you agree to receive recurring automated text messages from Poise Studios ("we," "us," "our") at the mobile number you provided. Messages may include [appointment reminders, order updates, account alerts, promotional offers, customer support follow-ups, etc. — customize to your actual use case]. Consent to receive these messages is not a condition of any purchase.
2. Message Frequency
You may receive up to [X] messages per [week/month]. Message frequency may vary depending on your activity and interactions with us.
3. Message and Data Rates
Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.
4. How to Opt Out and Get Help
You can unsubscribe the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. 5. Carrier Liability Disclaimer
Carriers are not liable for any delayed or undelivered messages.
